Freedom Of Information Publication Scheme

Adopted from the Freedom of Information Act April 2009.

The policy of the Council regarding the access of information held by the said Drayton Parish Council is as follows:

  1. The notice of the Annual Meeting of the Council and the Notice of all other Meetings will be published.
  2. The Agenda and Papers for the Public parts of Council Meetings will be released on the receipt of a proper request.
  3. Some of the agenda and documentary details concerning private parts of the Council Meetings will not be released.
  4. The Council will only release information held by them, which is NOT Exempt information if the application is made in writing (including by Email) and must pay a fee.
  5. The Council will only release as per the DP Act “personal data”, if the applicant is the person in question, on receipt of a proper request.
  6. The Council will not release information, which is accessible to the applicant through other means.
  7. The Council will not release information already intended for future publication.
  8. The Council will not release some Commercial information.
  9. The Council will not release information requested vexatiously or repeatedly.
  10. The Council will not release information, which would cost too much to find and release.
  11. The Council will not release information (including Emails), which is held by a member of the Council in his or her right.
  12. The Council will not release any information relating to NATIONAL security.
  13. The Council will not release information whose disclosure is prohibited by (other) legislation.
  14. The Council will not release communications with Royalty or about Honours.
  15. The Council as per the DP Act “personal data” will not release information if the applicant is not the person.
  16. The Council will not release Trade Secrets.
  17. The Council will not release information provided in confidence, where breach would be actionable.
  18. The Council will not release most communications with lawyers under “legal professional privilege”.
  19. The Council will not release information whose disclosure would prejudice the detection of crime or the prosecution of offenders.
  20. The Council will not release information which the Minister says would be prejudicial to the effective conduct of personal affairs.
  21. The Council will respond within 20 days of a written request to information they have agreed to release.
  22. The Council will charge a fee of up to £450 maximum which is worked on hourly rate of £25 per hour for 18 hours staff time plus disbursements for the issue of information relating to parts they have ,agreed or by statute they must release.
